How the Court Decides on Custody Matters
The conventionally held belief was that mothers were awarded custody. However, due to shifting perceived attitudes and amendments to the law, all parents are given due consideration. In New York, custody refers to two separate ideas—one being the physical custody of the child and the other being who has the legal rights to make decisions regarding the child's welfare.
The courts will review many factors to decide on custody matters, including:

- Each parent's ability to get along with and maintain a civil relationship with the other
Legal and physical custody can be either joint or sole custody. Joint custody means that both parents make major decisions regarding their child, such as medical, educational, religion, and financial decisions. Sole custody, on the other hand, only gives one parent the ability to make these choices.
