Deciding on child support matters is an integral part of any divorce case, as State law requires it. Child support should never be used as a weapon to discount one or the other spouse, although that has often been the commonly held belief. How to File for Child Support
Child support payments are provided to custodial parents, the ones who retain primary physical custody of the child or children. To begin the process, the custodial parent must file a petition to the courts to ask for financial support from the non-custodial parent. The courts will then use all of the available information, including financial records, tax documents, pay stubs, and other materials to decide on the matter.
Child support is provided based on the following percentages:
- 1 child: 17% of the parent's income
- 2 children: 25% of the parent's income
- 3 children: 29% of the parent's income
- 4 children: 31% of the parent's income
- 5 children or more: at least 35% of the income
These fixed percentages are based on the parental income and the number of children to support. However, the parents' combined income must not exceed $136, 000. Otherwise, the court has the discretion to impose another set of percentages to base child support.
